Lasting Power of Attorney solicitors in Tunbridge Wells

What is a Lasting Power of Attorney?

A Lasting Power of Attorney (LPA) allows someone you trust to make decisions on your behalf if you are no longer able to do so yourself, or if you need some assistance with managing your affairs. Without one, your loved ones will not automatically have the legal authority to manage your finances or health care, and they may need to apply for a Court of Protection order.

There are two types of LPA:

  • Property and Financial Affairs
  • Health and Welfare

You can choose to set up one or both; however, we always recommend having both in place. Any adult with mental capacity can make an LPA, and doing so ensures your affairs are handled by the right people if the unexpected happens.

How we can help…

We can support you through the preparation and registration process, giving you peace of mind that your future is in safe hands.

If someone loses the ability to make decisions on their own and does not have an LPA in place, a Deputyship Order from the Court of Protection is usually required. We can assist with preparing and submitting the application to enable the Court appointed Deputy to make decisions about an individual’s affairs on their behalf.

We can also prepare General Power of Attorney documents.

Do I need both types of LPA?

We recommend having both Property and Financial Affairs and Health and Welfare LPAs in place. This ensures that all aspects of your life and care are covered if you become unable to make decisions yourself.

What happens if I do not have an LPA?

If you lose capacity without an LPA, your loved ones may need to apply for a Deputyship Order from the Court of Protection. This process can be time consuming and more expensive than having an LPA prepared in advance.

Can I cancel or change my LPA?

Yes. As long as you have mental capacity, you can revoke or update your LPA at any time. We can assist with preparing the necessary documentation.
